- OFFROAD ADVENTURES FIJI PTE LTD (ATV) is committed to providing quality services to you. These terms and conditions outline the obligations and conditions of use in participation of all-terrain vehicle activity. In participating in this activity, you agree to be bound by these Terms and Conditions. If you do not accept these terms and conditions, you must refrain from participating in the activity.
OFFROAD ADVENTURES FIJI offers:
- Longer tours with duration 4 hours period.
ATV advises that tour locations and duration for the tour may be subject to last minute changes based on weather and safety conditions of the trip.
ATV recommends that all participants must wear Closed Shoe footwear for the trips. All helmets and Gloves will be provided by ATV.
A valid Driver’s Licence or Learners Permit in home country must be held for Drivers. Drivers are required to have 0.00 Alcohol and No Drugs
Follow the strict safety rules and regulations while riding an all-terrain vehicle. Riders are required to sign the waiver form before being allowed to ride. Always wear the provided equipment and required safety gear.
Our guides are trained to read the conditions of the sand, landscape, weather, and rider confidence.
Riders must act within the advice and instructions of the guides at all times.
Be patient and respectful to our guides as they attempt to cater to all riding conditions and capabilities (likely to be a NOVICE group and experienced one).
Riding under the influence of alcohol or other substances is not permitted. Please do not speed beyond the permitted limit.
Respect the local trail environment and other riders and do not litter along the trail of the tour.
Riding will only be permitted to the areas that we provide according to the tour package. Riding with safety is our foremost priority.
Please arrive on time for your scheduled tour.
Riders will be required to sign a Waiver and Release form prior to participation. Riders will not be allowed to participate in the activity if this form is not signed.
Booking Process
Online Bookings:
- Bookings can be made directly through our website using a credit or debit card.
- We utilize a trusted third-party payment processor, Stripe, to securely handle your payments.
In-Office Payments:
- No cash payments will be accepted on the day of the tour.
- For in-office payments, simply scan our QR code using your credit card to complete the transaction.
Free Hotel Pickup:
- We offer complimentary pickup from hotels located within a 10 km radius of Nadi Airport.
Confirmation process after booking.
Confirmation Email will be sent out, on the email will have Our Details and Contact Details, Time of Booking, what Package has been chosen and Amount of People. What to bring on the day and also if pick up selected what time that will be.
Pricing and Payment Terms:
– Long Tour –
– $ 389 FJD Driver
– $329FJD Passenger
- Accepted payment methods (e.g., credit cards, PayPal).
– Credit/ Debit Cards will Incur 5% Fee
- Currency accepted (Fijian dollars or other currencies).
Cancellation and Refund Policy
Cancellations Within 24 Hours:
- If you cancel within 24 hours of your booking time, 100% of the tour cost is forfeited.
Cancellations Within 48 Hours:
- If you cancel within 48 hours but more than 24 hours before your booking time, you will receive a 50% refund.
Cancellations Outside 48 Hours:
- If you cancel outside of the 48-hour window, you will receive a 100% refund.
Rescheduling Due to Safety or Extreme Weather:
- If we have to cancel your tour for the day due to safety concerns or extreme weather conditions, we will offer a reschedule to a time suitable for you. Please note that no refund will be given in such cases.
- Deadline for cancellations and any associated fees.
If you arrive late or miss the tour you forfeit your spot and the fees paid will not be refunded, we suggest all guests arrive 30min prior to their scheduled departure time.
No Refund for is processed for cancellations within 48 Hours of Booking 50% Refund is available if cancellation is requested outside of the 48 hours of booking.
Where cancellation is requested less than 48 hours of the event date, the client may incur cancellation fees and, in some cases, the payment is nonrefundable.
All late arrivals and/or no shows will need to be rescheduled or put on credit.
Our tour lasts 4-5 hours. If you arrive late, you can still join us, but please note that we will not revisit any locations we have already visited.
All late arrivals and/or no shows will incur a fee of $25.00 per person.
It is the policy that refunds will be processed back onto the same card that was used for paying.
Refunds may take up to 21 Business days for processing. This is depending on Foreign Bank and the type of card.

Safety Regulations:
- Requirements for participants (e.g., age restrictions, driver’s license). – Drivers must be aged over 16 years Old.
– Hold a Current Drivers Licence or Learners Permit all countries applicable, has to be brought on the day to be sighted by us, No Refund if Fails to bring.
– Bring Credit card in same name as Booking for Bond
– Be Alcohol and Drug Free
– Closed Toe Shoes
- Safety instructions and regulations during the ATV tour.
– Prestart Safety Meeting will be held by us to familiarise customer with the ATV and Explain our safety procedures and rules.
– Must listen to the Tour Guide at all times during tour failure to do so will result in your tour being cut early.
– Road Rules must be Practised at all times during tour.
Liability Waiver:
The client acknowledges that there are risks associated with ATV tours.
ACKNOWLEDGEMENT OF RISK AND WAIVER OF LIABILITY
To the extent permitted by law, and in consideration for being allowed to participate in the ACTIVITY, the client holds harmless, discharges and releases the ATV from any and all liability, claims, causes of actions, damages or demands of any kind and nature whatsoever that may arise from or in connection with my participation in any activities related to the ACTIVITY, whether caused by the negligence or carelessness of the ATV or otherwise
It is the client’s express intent that this Acknowledgement of Risk and Waiver of Liability shall bind their spouse, the members of their family and their estate, heirs, administrators, personal representatives, and assigns. The client agrees to save and hold harmless, indemnify, and defend ATV from any claim by the aforementioned parties arising out of my participation in the ACTIVITY.
The client recognizes and acknowledges that ATV makes no guarantees, warranties, representations, or other promises relative to the ACTIVITY, and
assumes no liability or responsibility for injury or property damage that I may sustain as a result of participation in the ACTIVITY and assumes no liability or responsibility for injury or property damage that I may sustain as a result of participation in the ACTIVITY.
The client further understands and agrees that this is a release of liability and indemnity agreement, and it is intended to be as broad and inclusive as permitted by law. In any portion hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect.
The client hereby also certifies that with or without accommodation, *I have no health-related reasons or problems that preclude or restrict my participation in the ACTIVITY. The client hereby consents to and understand to be solely responsible for the cost of first aid, emergency medical care, and, if necessary, admission to an accredited hospital for executing such care or treatment for injuries that I may sustain while participating in any activity associated with the ACTIVITY.
Weather and Conditions:
Activities will be conducted based on weather conditions and may sometimes be cancelled at short notice. In such circumstances the client does not have any claim against ATV for cancelling events at such short notices.
Health and Fitness Requirements:
The activities are not recommended for Pregnant woman, and also for those medically known to be of high-risk medical conditions.
Equipment and Gear:
ATV will supply the clients with safe and in good working order ATV Bikes. They will also provide the clients with helmets and safety gear.
However, it is the responsibility of participants for proper use and care of equipment.
Indemnification Clause:
Agreement by participants to indemnify our company for any claims arising from their actions during the tour.
Governing Law and Jurisdiction:
- Choice of law (Fijian law) and jurisdiction (Fiji courts) governing the agreement.
Changes to Terms and Conditions:
- Notification process for changes to the terms and conditions.

Miscellaneous Provisions:
- Any additional clauses relevant to ATV tours in Fiji or our specific business operations.
Dispute resolution.
If a dispute arises between the parties neither party may commence any court or arbitration proceedings, except where that party seeks urgent interlocutory relief, unless it has first complied with this clause.
(a) Complaint
The complainant must serve notice in writing on the respondent of the following:
(i) the nature of the dispute;
(ii) the outcome the complainant desires; and
(iii) the action the complainant believes will settle the dispute.
(b) Endeavour to resolve dispute.
Within 14 days of the receipt by the respondent of the notice the parties must use their best endevours to resolve the dispute by negotiation.
(c) Mediation
If after those 14 days there are any unresolved issues, the parties will refer their dispute to a mediator nominated by the Resolution Institute, and the parties will participate in good faith in mediation under the Resolution Institute Mediation Rules.
(d) Survival of this clause
This clause survives the termination of this deed.

(a) that I have read this document in its entirety, understand it, and sign it voluntarily; and
(b) (b) that this Acknowledgement of Risk and Waiver of Liability is the entire agreement between the parties hereto and its terms are contractual and not a mere recital.
